Refund & Cancellation Policy

How rescheduling, cancellations, deposits and refunds work for our workshops, packages and software projects.

This refund policy explains how you can reschedule or cancel a workshop, development package or project with Adriel Corp, how deposits and milestone payments are treated, and how to request a refund. We aim to be fair and transparent: you pay for the work we have done, and you are refunded for work we have not.

This policy forms part of our Terms & Conditions. It does not limit any rights you have under the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) or the Consumer Protection Act 68 of 2008 (“CPA”). If anything in this policy conflicts with those rights, your statutory rights prevail.

1. What this policy covers

This policy applies to:

Where a signed project agreement contains its own cancellation terms, those terms apply to that project together with any rights you have by law.

2. The nature of our services

We sell professional digital services, not physical goods, so there is nothing to return. Much of our work is time-based and tailored to your business: once we have reserved time in our schedule, prepared for a session or written code for you, that time cannot be resold. Our refund rules reflect this, while making sure you never pay for work that has not been done or that we cannot deliver.

3. Your cooling-off right under ECTA

If you are a consumer (a natural person buying as an end user) and you buy a service from our website, section 44 of ECTA gives you the right to cancel the transaction without reason and without penalty within seven days after the agreement is concluded. If you cancel within this period, we will refund any payment you have made within 30 days of the date of cancellation.

Under section 42(2) of ECTA, this cooling-off right does not apply to services that began, with your consent, before the end of the seven-day period. When you book a workshop or package that you want to start within seven days of ordering, we will ask you to confirm that you agree to the service starting early and understand that this ends your cooling-off right for the part of the service already performed. Other exclusions in section 42 of ECTA may also apply in specific cases.

Businesses and other juristic persons do not have this statutory cooling-off right, but the rest of this policy applies to them.

4. Workshops

4.1 Rescheduling

We understand that plans change. You may reschedule a confirmed workshop free of charge once if you tell us at least five business days before the scheduled date. Later requests will be accommodated where we can, subject to availability, and we may charge any non-refundable costs we have already incurred, such as venue or travel bookings made at your request.

4.2 Cancelling

If you cancel a confirmed workshop outside the ECTA cooling-off period:

When you cancel Refund
10 or more business days before the workshop Full refund, less any non-refundable third-party costs incurred at your request
5 to 9 business days before the workshop 50% refund, or full credit towards a rescheduled date within three months
Fewer than 5 business days before, or no-show No refund, but we will provide any preparatory materials and offer one rescheduled date within three months, subject to availability

Where the CPA applies to your booking, any cancellation charge will be no more than a reasonable charge, as section 17 of the CPA requires, taking into account the notice you gave, our ability to fill the time and the costs we incurred.

5. Development packages and deposits

For development packages and custom projects, we usually ask for a deposit before work begins. The deposit secures time in our schedule and covers initial planning, the conceptual phase and project set-up.

  • Before work starts: if you cancel before we have started any work, we will refund the deposit in full, less any non-refundable third-party costs incurred at your request and agreed in writing.
  • After work starts: the deposit is applied to the work already performed. If the value of that work is less than the deposit, we will refund the difference. If it is more, we will invoice the balance.

The deposit amount and what it covers will always be stated in your order confirmation, quote or project agreement.

6. Milestone-based projects

Larger projects are divided into milestones that follow our six-phase development process. Each milestone has defined deliverables and acceptance criteria.

  • Payments for milestones that have been delivered and accepted are not refundable, because the corresponding work has been completed and handed over.
  • If you cancel during a milestone, you pay for the work done on that milestone up to the cancellation date, calculated pro rata or on the time-and-materials basis set out in your agreement. Any amount you have prepaid for work not yet performed will be refunded.
  • Once all amounts due have been paid, we will hand over the completed work and work in progress, including source code, as described in our Terms & Conditions.

7. If we cancel or cannot deliver

If we need to cancel a workshop, package or project for reasons within our control, or we are unable to deliver what was agreed, you may choose a rescheduled date or a full refund of amounts paid for services not yet provided. If an event beyond our reasonable control prevents delivery, we will offer a new date first, and refund you for services not provided if a new date is not acceptable to you.

8. If you are unhappy with the service

If a service we provided does not meet the agreed scope or standard, please tell us as soon as possible, and in any event within the acceptance or warranty period in your agreement. We will first try to put things right by correcting the work or performing the service again. Where the CPA applies, you also have the right under section 54 to require us to remedy the defect or refund a reasonable portion of the price, having regard to the extent of the failure.

9. How to request a cancellation or refund

Email [email protected] with the subject line “Cancellation request” or “Refund request” and include:

  • your name and company (if applicable);
  • your order number, quote reference or project name;
  • whether you want to reschedule, cancel or request a refund; and
  • for refunds, the reason (optional for ECTA cooling-off cancellations) and the bank account details for the refund.

We will acknowledge your request within two business days and confirm the outcome in writing. To protect you from fraud, we may verify any new bank details with you before paying.

10. How refunds are paid

Refunds are paid by EFT to the account you nominate or, where you paid through an online payment gateway, back to the original payment method where the gateway allows it. We will process approved refunds within 30 days of the cancellation date, and usually sooner. Your bank may take a few additional business days to reflect the payment. Refunds are made in South African Rand; we are not responsible for exchange rate differences or charges levied by your own bank.
